RELEASE OF LIABILITY AND WAIVER

• I understand that I must be 18 years old to submit the application on-line.  Teens under 18 need to print out the application and have it signed by a parent/guardian.
• I understand that because I may handle animals, it is important to discuss being vaccinated against tetanus with my physician. I release the Animal Coalition of Delaware County from all responsibility that may occur because of my not pursuing this matter further and I understand whatever decision I make is at my own risk. I have read, understand and agree to the above tetanus information.

• I acknowledge and understand that as a volunteer of the Animal Coalition of Delaware County, I am not covered by workers’ compensation or any other insurance policy through the Animal Coalition of Delaware County for any loss of property or damages or injuries I may sustain during volunteer activities.  

• I fully understand that as a part of my volunteer work for the Animal Coalition of Delaware County (Animal Coalition), I may come into contact with animals either by directly handling them, or through assisting in their care and adoption. Further, I understand that working with animals carries a risk of injury, and that it is possible that I may be bitten, scratched, and/or otherwise injured.  My signature to this volunteer liability release attests to my intent to hold harmless and release from all liability ACDC or any of its past, present or future Officers, agents, volunteers, employees or assigns, from all acts which are related to the normal performance of required and implied duties.

• I agree that Animal Coalition may photograph my participation in this program, and I hereby release any such photographs to Animal Coalition for use in its programs, marketing, and publications.  

I hereby grant the Animal Coalition of Delaware County, Inc., its employees, volunteers, and those acting with its authorization, the right and permission to copyright, use, and/or publish photographic pictures or portraits of me (or my child if the person photographed is under 18 years of age) in its own, sponsored organizations’, and programs’ promotional materials. These materials include, but are not limited to magazines, brochures, videos, catalogs, press releases, and websites.

I hereby waive any right to inspect or approve the finished photographs, advertising copy, videos, or printed matter that may be used in conjunction there within or to the eventual use that might be applied. I hereby release, discharge, and agree to hold harmless ACDC, its employees, volunteers, or vendors (including any firm publishing and/or distributing the finished product) from and against any liability as a result of any distortion, blurring, or alteration that may occur in the taking, processing, or reproduction of the finished product.

• I give permission to be added to a contact distribution list to obtain material from Animal Coalition.

• I acknowledge that I am a volunteer with the Animal Coalition of Delaware County, Inc.  For consideration which I acknowledge, I agree to assign to the Animal Coalition of Delaware County, Inc., the copyright in any materials I create (the Works) within the course of my volunteer work.   

I hereby grant the Animal Coalition of Delaware County, Inc., its employees, volunteers, and those acting with its authorization, the right and permission to copyright, use, and/or publish the Works in its own, sponsored organizations’, and programs’ promotional materials. By assigning all right, title and interest in the Works, the Animal Coalition of Delaware County, Inc. agrees to: 
 
     A) Allow me to include the Works or reproduction of the Works in my portfolio of such compilation, to be shown to my prospective employers or clients.  All such portfolio uses must include a notice of the Animal Coalition of Delaware County’s copyright ownership.

     B) Acknowledge my transfer of the Works to the Animal Coalition of Delaware County, Inc. as a charitable contribution.

     C) Terms of credits and acknowledgements will vary per project. 
 
I warrant that any Works I create pursuant to this understanding are original and do not infringe any intellectual property rights or violate any laws related to libel, privacy, or otherwise.  I agree to indemnify and hold harmless the Animal Coalition of Delaware County, Inc. in any action arising out of, or relating to, these representations and warranties. 
 
I hereby warrant that I am competent to agree in my own name insofar as the above is concerned. 

• I shall defend, indemnify, and hold harmless for, from and against the Animal Coalition of Delaware County, including their respective employees, agents, representatives, assigns, successors, and subcontractors for, from and against all costs, claims, losses, liabilities, property damage, bodily injury or death, intellectual property infringement (including reasonable fees of attorneys) (“Claim”), incident to or arising out of my (i) failure to follow proper procedures as set forth in the Volunteer Handbook; (ii) gross negligence, willful misconduct, or omission(s); and/or (iii) violation federal, state or local law, regulation or other ordinance.

My signature, whether original, by fax or any other electronic means, is valid as if it were an original signature.

I acknowledge that this is an application only and does not guarantee I will be accepted as a volunteer.
